Terms of Service

These terms apply when you use cybercavetech.com or hire Cybercave Technologies ("we", "us") for any service. Your written quote or agreement adds the details for your job. If the two ever disagree, your signed quote or agreement wins.
1. Who we work with
Our services are for adults 18 and older and for businesses only. By hiring us, you confirm you're 18 or older and able to agree to these terms for yourself or your business.
2. Services and prices
Our current services and prices are listed on our website:
- Website hosting: Starter $25/month, Managed $60/month. Plan details, storage and bandwidth limits, add-ons and fair-use rules are on our website design, hosting and management page.
- Website design: from $600 one-time, waived with a 12-month hosting plan.
- IT Service Contracts: 3, 6 or 12 months at $125, $115 or $100 per month & employee, with a $100, $200 or $300 deposit. All contracts include unlimited remote support and unlimited on-site support with a $100 site visit fee per visit plus $0.60 per mile.
- General Services: $200 Standard Services.
- Advanced Services: $250 per hour for consulting and training.
- Custom and Specialized Services: priced in your written quote.
Your initial consultation is free. Every job starts with a written quote. Any change to the scope, price or timeline must be written on a Change Order and accepted by both of us before the extra work starts.
3. Deposits and when work starts
All website building services need a deposit of 50% of the total quote before work starts. The deposit covers initial build-out costs. If your $600 design fee is waived with a 12-month plan, the deposit is half of the 12-month plan total. Work starts when we email you to confirm it.
4. Website design revisions
- The price includes 3 rounds of revisions on the design preview.
- A "round" means one combined list of changes sent at the same time.
- Extra rounds, or changes that add new pages or features, need a Change Order and are billed at $50 per hour.
5. Paying us
- Due date: Invoices are due within 15 days of the invoice date.
- Late fee: Unpaid balances more than 15 days past the invoice date are charged a flat late fee of $15.
- Service pause: If a balance is still unpaid 30 days after it is due, we may pause service (including hosting or support) after notice by email, until the account is brought current.
- Payment methods: PayPal, Cash App, cash, or check.
6. Automatic renewal (hosting plans and IT Service Contracts)
Hosting plans and IT Service Contracts renew automatically. Your agreement includes this clause, and you agree to it separately by checking a box and initialing: "I understand this service renews automatically and authorize recurring charges as described above."
- Renewal: your agreement renews automatically for successive terms (1-month or the same length as your first term, as stated in your agreement) at the then-current rate, unless either of us cancels.
- Price and billing: your agreement states your charge, how often you're billed and the billing date. You're charged to the payment method on file until you cancel.
- Price changes: we'll tell you in writing at least 30 days before any price change takes effect.
- To cancel: email support@cybercavetech.com at any time. Cancellation takes effect at the end of the current paid term. No fees apply for cancelling. IT Service Contracts (retainers) require 30 days' written notice.
We'll confirm your sign-up and any cancellation by email. For plans of 6 months or longer, we'll email you a reminder before each renewal.
7. Refunds
Refunds and cancellations follow our Refund Policy, which is part of every agreement.
8. What you're responsible for
- Giving us accurate information, and keeping your contact and billing information current.
- Owning, or having permission to use, everything you send us. You are responsible for the content you provide, and for having the rights to use it.
- Keeping your own backups. You're responsible for keeping your own current backup copies of your important data, files and website content. Any backups we keep are an added safeguard and are not your only copy. We're not liable for lost data you could have restored from your own backup.
- Giving us reasonable access to devices, accounts and your location when we need it to do the work, and keeping any login details we give you private.
9. Who owns what
- Your content (text, photos, logos you provide) stays yours at all times.
- Your domain name belongs to you.
- The finished website design becomes yours once the project is paid in full. Until then, Cybercave Technologies owns it.
- Our tools and reusable pieces (code libraries, templates, frameworks and know-how we use across projects) stay ours, but you get a permanent license to use them as part of your website.
- Third-party items (fonts, stock photos, plugins, themes) are covered by their own licenses.
- We may show your finished site in our portfolio (cybercavetech.com/work) unless you tell us not to in writing.
10. Acceptable use for websites we host
Don't use our hosting for anything illegal, harmful, infringing, spam, or malware. Plans cover normal website use: pages, images, and documents like menus, brochures and forms. They don't cover video or audio streaming (embed from YouTube or Vimeo instead), large downloads over about 25 MB, or file sharing or backup storage for other systems. Sites are delivered through Cloudflare and must also follow Cloudflare's terms.
If your use goes beyond fair use, we'll contact you to talk through options before taking any action, except where needed to protect the server or other customers. We may suspend or end service for non-payment or a serious breach of the fair-use or acceptable-use rules, after notice where reasonable.
11. Uptime guarantee
Sites are locally hosted in Southwest Michigan with generator and battery backup.
Uptime guarantee. We guarantee 99% uptime for each hosted website in each calendar month, as measured by our public uptime tracker at cybercavetech.com/uptime/. If uptime falls below 99% in a month, you'll receive a refund of that month's hosting fee in proportion to the downtime beyond 1%. For example, 2% downtime earns a refund of 1% of that month's fee. To claim it, email support@cybercavetech.com within 30 days after the month ends. The refund can't exceed that month's hosting fee, and it's your only remedy for downtime. Downtime doesn't include: (a) maintenance we announce by email at least 48 hours ahead; (b) outages caused by you, your content, or changes you or your vendors make; (c) outages of Cloudflare's network, or attacks on our systems or your site that happen despite our reasonable security measures.
12. Limits on our liability
Except where the law does not allow it, Cybercave Technologies' total liability is limited to the amount you paid us under the relevant agreement in the 12 months before the claim. This limit doesn't apply to gross negligence, wilful misconduct, a breach of confidentiality or data protection, or amounts you owe us. It also doesn't apply to your responsibility for content you provide that infringes someone else's rights. Separately, neither of us is liable to the other for indirect or consequential damages, such as lost profits or lost data.
13. Privacy and accessibility
How we handle your information is explained in our Privacy Policy. We keep your data, passwords and business information private, use them only to provide services to you, and return or delete any credentials and data we hold when our work ends, as you direct. 14. Governing law
These terms are governed by the laws of the State of Michigan. Unless the law requires otherwise, any dispute will be handled in the state courts located in Allegan County, Michigan.
15. Changes to these terms
If we change these terms, we'll update the "Last updated" date at the top. For important changes affecting current clients, we'll email you first. Changes don't affect a quote or agreement you've already signed unless you agree in writing.
